TERMS AND CONDITIONS OF USE


1. PURPOSE AND DEFINITIONS

The purpose of the General Terms and Conditions of Use is to govern the relationship between Weavus SAS (the "Company", "Weavus" or "We"), a company in the process of being formed and temporarily represented by Mr. François BONIFACE via his micro-enterprise, and the users (the "User(s)" or "You") who wish to use the Services offered on the Weavus application ("the Application") and its website (the "Site").

The following terms and expressions shall have the meanings hereinafter assigned to them:


2. ACCEPTANCE OF THE GENERAL CONDITIONS OF USE

By registering on the Application and ticking the box expressing your consent to the General Terms of Use, You declare that You have read the General Terms of Use and expressly accept them without reservation and/or modification of any kind. The General Conditions of Use constitute a contract between You and the Company. They are therefore fully enforceable against You. If You do not wish to accept all or part of the General Conditions of Use, You are requested to refrain from using the Application.

The General Conditions of Use are further supplemented by our Privacy Policy.

In addition, Weavus may propose an interface with partner services, thus enriching the list of functionalities available from the Application. These services may, however, be subject to other conditions of use to which the User must consent and which are beyond the scope of responsibility of Weavus.


4. HOW TO ACCESS THE APPLICATION

The Application is available on Android phones and iPhones. It can be downloaded from the application stores offered on the iOS (App Store) and Android (Play Store) mobile platforms. It can be found by text search or by clicking on the corresponding link on the Site https://weavus.app..

In principle, the Application is accessible 24 hours a day, 7 days a week, except in the event of force majeure, computer or technical difficulties or difficulties linked to communication networks, for which Weavus cannot be held responsible. Weavus may interrupt access to the Application for maintenance purposes, and will endeavor to give prior notice to the User.


5. YOUR ACCOUNT

The Application is reserved exclusively for Users with an Account.

Registration is only permitted for legal entities and individuals aged 13 or over. Use by minors is subject to parental consent. An Account can be created at any time by entering the User's telephone number. Activation of the account will then be subject to validation of the telephone number by a one-time code received by SMS, the provision of the User's first and last name, and acceptance of the General Terms and Conditions of Use.


6. YOUR SECURE ACCESS

Access to your account is secured by a one-time code sent by SMS to your telephone number. It is the User's responsibility to secure access to SMS messages and not to divulge the password received. The User shall be solely responsible for accessing the Application using his/her telephone number, unless there is proof of fraudulent use for which he/she is not responsible.

The User may at any time request a change of telephone number by clicking on "Change my telephone number".

The User may also delete his or her Account at any time by accessing the "Profile" page. Any deletion of the Account is final. After deletion, the User will no longer be able to access the functionalities linked to the Account.

Weavus reserves the right to deactivate the User's entire Account at any time if the User fails to comply with any of the Terms of Use. The User will be notified in advance.


7. YOUR USE OF THE APPLICATION

You may only use the Application for lawful purposes and in compliance with all applicable laws, in particular Data Protection Legislation.

All Users of the Application undertake in particular not to:

By using the services of the Application, the User acknowledges and accepts that Weavus may delete or refuse, at any time, without compensation, a request that would be contrary, in particular, to French law, to the rules of distribution set out in particular in the General Conditions of Use and/or likely to infringe the rights of third parties.


8. INTELLECTUAL PROPERTY ON THE SITE AND APPLICATION

The semi-figurative trademark featured on the Site and Application is a registered trademark. All other Intellectual Property Rights (such as copyrights, in particular software copyrights, neighbouring rights, database producers' rights) relating to both the structure and content of the Application, and in particular the images, sounds, videos, photographs, logos, other trademarks, graphic elements, textual elements, visual elements, tools, software, documents, data, etc. (hereinafter collectively referred to as "Intellectual Property Rights") are protected by the laws in force relating to intellectual property, as well as by other applicable laws. The Site may contain hypertext links to third-party content or to websites operated by third-party partners. These links are provided for information purposes only. Weavus cannot be held responsible for the quality or accuracy of such content and websites.

Links published by users of the Application to other sites

The User may share in the Application hypertext links redirecting to other sites or applications. As described in section 7, the User undertakes to share only lawful content and is solely responsible for the content he/she shares or communicates to other users.

Links from other sites to the Site

The User may create a link to the Site from another website, but only if it complies with the following conditions:

Weavus reserves the right to request the User to remove any link to the Site at any time.


10. BREACH OF THESE TERMS AND CONDITIONS

In the event of a breach of the Terms of Use, Weavus may immediately terminate your right to access the Application. We also reserve the right to disclose your identity to any person and/or public body if We consider such disclosure to be in accordance with Data Protection Legislation and necessary in connection with any investigation or complaint regarding your use of the Application.


11. EXCLUSION OF LIABILITY

Weavus makes every effort to provide continuous access to the Application. However, the Company cannot guarantee the accessibility and continuous operation of the Application and its partner services. Weavus takes all necessary measures to ensure their availability.

Temporary interruption of the Application or services is nevertheless possible. The Company shall not be held liable in the event of the Application being unavailable, in particular if Users are unable to access all or part of the Application and/or partner services due to any technical fault or problem linked in particular to Internet network congestion, Internet service provider failure, human or electrical error, malicious intervention, software or hardware malfunctions and/or force majeure.

Weavus cannot guarantee that the information published on the Site is accurate, complete or up-to-date. No content and no indication or information published on the Site or given when accessing the Site may be interpreted as a guarantee given to Users, insofar as only the General Conditions of Use are intended to govern relations between the Company and Users. This limitation of liability includes any liability that may arise from third-party claims against Users.

Weavus cannot be held responsible for the use of the Application by Users.

Finally, Weavus cannot be held responsible for any damage of any kind suffered by Users as a result of using the Application in the context of their professional activity under employment law. In particular, Weavus may not be substituted for the User's employer for any damage resulting from the User's use of the Application at the request of said employer.


12. MODIFICATION

The Company reserves the right, at its sole discretion and at any time, to modify, supplement or delete all or part of the General Terms of Use. In this case, the User will be invited to take cognizance of the new General Terms of Use and must accept them again by checking a box to this effect in order to continue using the Services.


13. YOUR PERSONAL DATA

When using the Application, Weavus may collect and process some of your personal data. In processing your personal data, Weavus undertakes to comply with the Data Protection Legislation. For more information on how We process your personal data, please consult our Privacy Policy.


14. SEVERABILITY CLAUSE

If any provision of the Terms of Use is held to be void or invalid for any reason, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect.


15. APPLICABLE LAW AND JURISDICTION

The General Terms of Use are governed, interpreted and applied in accordance with French law.

Any dispute arising from the interpretation, modification or application of these terms and conditions shall, failing amicable settlement, be subject to the exclusive jurisdiction of the Paris courts.
